Despite getting bail from the Bombay high court on Wedesday, actor Shiney Ahuja has to spend another night in jail as the sessions court principal judge on Thursday declined to accept the bail of Rs 50,000 in cash and asked for a surety.

Was it an agenda to convict Shiney Ahuja from the start?

Shiney Ahuja's case took a political turn when Ex-Chief Minister of Maharashtra, Ashok Chavan and Chairperson of National women organisation, Girja Vyas intervened in the case right at the start. They came on air and pronounced Shiney Ahuja guilty even though the investigations had barely begun. Now we know for the fact that the girl retracted her statement and the said minister got kicked out of his office on charges of corruption.

Bombay HC Accepts Shiney's Appeal Against Conviction

We have full faith in our Judicial system

The appeal highlights:

1. Shiney moved to Bombay High Court challenging his conviction on the ground that it was a "perverse and illegal" judgement AND the High court admitted the appeal.
2. Judgement by lower court “unheard of in the history of criminal law.”
3. Apart from the girl denying the alleged offence, even the medical evidence is negative. Evidence given by doctors, who examined Shiney and the victim, stated that there are no injuries on the girl's body.
4. Even the semen and blood samples were negative of Shiney's DNA.
5. Not a single stain of semen and blood was found on the private parts of the girl or Shiney.
6. The CCTV footage of the building's lift lobby clearly shows the girl coming down calmly with her hair neatly combed and tied and clothes in order.

IN SHORT NO BLOOD OR SEMEN FOUND. DNA TESTS NEGETIVE. GIRL ADMITS THAT NO SEXUAL INTERCOURSE TOOK PLACE - FORGET RAPE.

There have been so many talks about this in the air. But the fact is that Shiney Ahuja did not have consensual sex with maid...he has always said that he is being framed and hasn't done any wrong.
So who started the rumor?
Well here goes...
1. On July 4, 2009, Times of India Mumbai publishes the following on Main page

2.  On July 5, 2009, Times of India in their online edition, posts the following :

Interesting fact in the judgement

Shiney was accused of section 376 (rape), 342 (wrongful confinement) and 506(II) (criminal intimidation by giving threat to victim).

Now shiney was acquitted for 342 which means he did not confine the victim. He was also acquited for 506(II) which means he did not threaten her. The victim said he did not rape her. I'm not sure whats going on.

DNA tests by uncertified lab!

The mysterious judgement stands on the fact of DNA results, which were apparently conducted by uncertified lab...Yes that is really strange thing to believe. The chain of custody in DNA evidence is most important and sources reveal that the chemical analyzer who testified in court also "categorically admitted that he did not follow any NABL guidelines at the Kalina lab". The National Accreditation Board for Testing and Calibration Laboratories (NABL) accreditation means that the lab conforms to the international standard for quality and competence. It judges competence of a lab to generate accurate test reports from the time a sample is collected to final delivery of a report.

This indicates that the reports which were produced by public prosecutor in the court aren't reliable. So how can a judgement be passed based on it?

How can someone use Shiney as a target to make a piece of news?
A mere publicity tactic or should I call this marketing yourself by crushing another soul!
We all know that media hype can be good or bad and our conscious knows what is right and wrong. Still people want to grab an opportunity to gain a bit of fame. I have hope that public sees the truth in these stories and not retain it as portrayed.

Something is mysterious with Shiney Ahuja's judgement

Sources added that the material presented before the court by Ahuja’s lawyers included CCTV footage of the actor’s building where the woman is seen leaving the premises unruffled

Shiney’s lawyers had also presented the girl’s phone records which indicate that she was talking to someone for more than half an hour between 3pm and 5pm, the duration of the alleged rape. Also, she had called Shiney 10 to 12 times on his landline the previous night, as also confirmed by the caller identification feature on the actor’s phone,” said a source close to the actor.

If the above is true, then what happened when the judgement was given? Did the judge ever consider these evidences which were presented? Were there any investigations to check what might have been the girl's motive behind this alegation?

What should general public expect from judiciary system?

Shiney Ahuja should be given justice. He is innocent and court can't ignore other facts which were presented.

Money making

I don't know how many of you would agree with me on this, but to my true understanding and knowledge maximum no. of cases in this context are farce and a mere money making gimmick by the players sitting outside! He and his family were too innocent to be trapped in the rut created by the players or enemies.

Mehak well said. I totally agree. We have had so many scandals these days, it is hard to trust the Indian system. But why do people who don't want to or don't give bribe have to suffer and be a victim. It is not just poor who suffer, even celebrities are made to suffer...and only powerful ones get away.

Celebrity victim!

I feel Shiney Ahuja is merely a celebrity victim. He is being punished for something he hasn't done. Even when the maid confessed nothing had happened, no one seems to believe it...and it hasn't been considered.
